This case involved a claim by an employee for compensation for a workplace injury. The employee argued the employer was liable for this even though the injury had occurred outside the workplace as the company statute stated it would compensate employees injured at any location. However, as the employee had not raised this argument initially at the court of first instance or court of appeal the court ignored it.

Background

An employee made a complaint against a company and requested the Labour Department to order the company to pay his compensation for a workplace injury. The department referred the case to the court. The employee filed a case against an insurance company and requested the court to order it to pay the value of compensation along with the company.

The court ruled that the two companies should pay the employee 5588.500 Dinars.

The two companies appealed the ruling before the court of appeal. The court abandoned the appealed ruling and rejected the case.
