Payment of Salaries – Illegal Settlement Documents – Consideration of Appeal Relating to Appealed Ruling
A case involved a dispute between an employee and an institution over the payment of his salaries.
Background
An employee filed a case against an institution requesting that the court order it to pay his salaries.
The court ruled that the institution pay the employee 17618 Dinars.
The institution appealed and the appeal court abandoned the ruling and rejected the case.
The employee appealed by cassation.
Decision
Before the cassation court the employee argued that the ruling had insufficient evidence of causation as he had maintained before the court that the settlement documents were illegal as they did not include an accurate statement of his dues.
The court held that this argument was invalid as the court can only consider the appeal related to the appealed ruling.
The court therefore dismissed the appeal.
