Background
The company filed a case against a bank requesting that the court order it to dismiss a decision which disapproved the budget of the company over three years.
The court ruled that the decision be dismissed.
The bank appealed and the appeal court abandoned the ruling and rejected the case.
The company appealed by cassation.
Decision
Before the cassation court the company argued that the ruling had erred in the application of law and violated its right in defence as the court had ignored its defence proving its claims.
The court held that this argument was invalid as the court had rejected the case as the delay in approving the company's budget did not mean that an administrative decision existed.
The court therefore dismissed the appeal.
