KCC 53/1997

A case involved a dispute between a claimant and defendants over the dismissal of a decision and the payment of his salaries.

Background

A claimant filed a case against defendants requesting that the court order them to dismiss a decision which dismissed him from the second defendant company's board of directors and order it to pay his salaries.

The court ruled that the second defendant pay the claimant 11228.639 Dinars.

The claimant and second defendant appealed and the appeal court abandoned the ruling and rejected the case.

The claimant appealed by cassation.

Decision

Before the cassation court the claimant argued that the ruling had violated the law as the court had ignored the amendments to his requests.

The court stated that this argument was invalid as the court is obliged to consider the final requests of the parties, which has nothing to do with previous requests.

The court therefore dismissed the appeal.
