KCC 441/1998

This case involved a request to the court to suspend the implementation of an arbitration ruling on the grounds that a particular project had been treated as being part of the settlement agreement although it was not included in a relevant appendix. This was irrelevant as the arbitrator had listed this project as one of those of the company and there had been no dispute by the parties of this being done.

Background

A claimant filed a case against a company and requested the court to suspend the implementation of the arbitration ruling No. 7/1997 and appoint an expert to make a final clearance between the two parties.

The court rejected the case.

The claimant appealed the ruling before the court of appeal. The court upheld the appealed ruling.
