KCC 24/1998

This case involved claims by an employer for amounts owed to them after the employee had left their employment without giving notice and had not attended a training course.

Background

A company filed a case against two defendants and requested the court to order the defendants to pay an amount of money and legal interest. The company said that the first defendant had not attended the training course and so the company had right to claim back the amount it spent on the first defendant. The company said that the second defendant was the guarantor of the second defendant.

The court rejected the case.

The company appealed the ruling before the court of appeal. The court upheld the appealed ruling.

Decision

The company appealed the ruling before the court of cassation and said in its grounds of appeal that the ruling had insufficient evidence of causation and the first defendant had left his job without notice which meant that he had violated his obligations according to the contract.
