Background

An employee filed a case against a company requesting that the court order it to pay him an advantage award.

The court ruled that the company pay the employee 42319.627 Dinars.

The employee and company appealed and the appeal court upheld the ruling.

The company appealed by cassation.

Decision

Before the cassation court the company argued that the ruling had erred in the application of law as the Institution of Social Insurance was obliged to pay the mentioned award under Article 82 of the Kuwait Social Insurance Law, Kuwait Law No. 61/1976.

The court held that this argument was valid and repealed the ruling.
