KCC 15/1997

This case involved a claim by an employee for unpaid salary. It was wrongly argued that the case had been incorrectly based on an expert report which had only used testimony from one witness.

Background

An employee made a complaint against a company before the Labour Department and requested the department to order the company to pay his salary. The department referred the case to the court.

The court ruled that the company should pay the employee 6857.361 Dinars.

The employee and the company appealed the ruling before the court of appeal. The court upheld the appealed ruling.

Decision

The company appealed the ruling before the court of cassation and stated in its grounds of appeal that the ruling had erred in the application of law and that the court had established its ruling based on the expert report although this report was based on the testimony of one witness in violation of the rules of evidence.

The court stated this argument was invalid because the Law of Evidence did not determine the number of witnesses needed to prove certain cases.

The court dismissed the appeal.
