Before the cassation court the owner argued that the ruling had erred in the application of law as he was not informed with the case documents until the elementary ruling had been issued and thus the dispute did not exist.

The court held that this argument was invalid as the case documents revealed that the owner had been informed.

The court therefore dismissed the appeal.
