Three defendants were accused and convicted of fabrication in absentia. One defendant was to be deported and another tried to object to the ruling. It was stated they did not have the right to do so, even though they had reached a reconciliation with the victim's heirs as the crime was not in the amnesty crime list.

Background

The Public Prosecution accused three defendants of fabrication.

The court ruled in absentia that the defendants should be imprisoned for five years and the first defendant should be deported from Kuwait after the execution of the ruling.

The third defendant objected to the ruling. The court said that the defendant did not have the right to object the ruling.

The third defendant appealed the ruling before the court of appeal. The court of appeal abandoned the decision and referred the case to a criminal court. The court rejected the objection. The defendant appealed the ruling before the court of appeal. The court upheld the appealed ruling.
