Background
An employee made a complaint against a company before the Labour Department and requested the department to order the company to pay their salary. The department referred the case to the court.
The court ruled that the company should pay the employee 10717.020 Dinars.
The company appealed the ruling before the court of appeal. The court upheld the appealed ruling.
Decision
The company appealed the ruling before the court of cassation and stated in its grounds of appeal that the ruling had erred in the application of law and had insufficient evidence of causation because the employee had been dismissed from his job due to their absence and they did not deserve severance pay.
The court stated this argument was valid because the court had ignored the defence made by the company about the reasons for dismissal.
The court repealed the ruling.
