This case involved a claim for compensation against the minister of finance by the heirs of man who had died in a workplace accident. The case was wrongly rejected because the heirs had not followed the correct procedures when filing it. However, the court had a mandate to consider it.
Background
The heirs of an employee filed a case against the deputy minister of finance and the representative of a company and requested the court order them to pay 10000 Dinars in compensation for the death of their father at work. The heirs then added a defendant to the case and requested the court order all the defendants to pay the amount.
The court stated it had no mandate to consider the case and referred it to the Labour Department. The Labour Department rejected the case.
The heirs appealed the ruling before the court of appeal. The court upheld the appealed ruling.
