Background
An employee filed a case against a company requesting that the court order the company to pay his salaries plus compensation for a work injury.
The court rejected the case.
The employee appealed and the appeal court ruled that the company pay the employee 14790 Dinars.
The company appealed by cassation.
Decision
Before the cassation court the company argued that the ruling had erred in the application of law and had insufficient evidence of causation as the employee worked offshore and received his wage per trip and thus maritime laws should have applied to the case.
The court held that this argument was invalid as the company filed its appeal against the first instance ruling and not the appeal court's ruling.
The court therefore dismissed the appeal.
