KCC 84/1995

This case involved a claim by an employee for their dues. The employer tried to appeal on the basis it objected to the conclusions of the expert report. It had not however, given reasons for its appeal or objections to the expert report.

Background

An employee made a complaint against a company and requested the Labour Department order the company to pay his dues. The department referred the case to the court.

The court ruled the company should pay the employee 20601.540 Dinars.

The company appealed the ruling before the court of appeal. The court upheld the appealed ruling.

Decision

The company appealed the ruling before the court of cassation and stated in its grounds of appeal that the ruling had insufficient evidence and the court had established its ruling based on an expert report although it had objected to its conclusions.

The court stated this argument was invalid because the company had not revealled the reasons for its appeal. The court stated the company had also not revealled its objections to the expert report.

The court dismissed the appeal.
