KCC 81/1995

A case involved a dispute between an employee and a bank over the payment of his salaries.

Background

An employee filed a case against a bank requesting that the court order the bank to pay his salaries.

The court ruled that the bank pay the employee 11264.653 Dinars.

The employee and bank appealed and the appeal court abandoned the ruling and rejected the case.

The employee appealed by cassation.

Decision

Before the cassation court the employee argued that the ruling had erred in the application of law as the court had ignored his request for compensation for unjustified dismissal based on the dismissal having complied with Article 53 of the Kuwait Labour Law, Kuwait Law No. 38/1964.

The court held that this argument was invalid as the court had established its ruling on compensation for the termination of an indefinite period contract only including notice period salary amounts.

The court therefore dismissed the appeal.
