Background
An employee made a complaint against an employer and requested the Labour Department to order the employer to pay her dues. The department referred the case to the court.
The court ruled that the employer should pay the employee 7285.395 Dinars.
The employer appealed the ruling before the court of appeal. The court changed the appealed ruling and ruled that the employer should pay the employee 141.670 Dinars.
Decision
The employee appealed the ruling before the court of cassation and stated in her grounds of appeal that the ruling had erred in the application of law because the court had established its ruling on an endorsement she had signed although this document violated the general system. The employee stated she had been forced to sign the document in order to renew her residence permit.
The court stated this argument was valid because the court had ignored the contract signed between the two parties.
The court repealed the ruling.
