KCC 54/1996

A case involved a dispute between an employee and a company over the payment of his salaries.

Background

An employee filed a case against a company requesting that the court order the company to pay his salaries.

The court ruled that the company pay the employee 11481.151 Dinars.

The employee and company appealed and the appeal court ruled that the company pay the employee 1553.151 Dinars.

The employee appealed by cassation.

Decision

Before the cassation court the employee argued that the ruling had erred in the application of law as the court ruled that the company pay the value of annual holidays in Kuwaiti Dinars although he had worked in the company's Cairo branch for some time. Furthermore, that the court had established its ruling on customary documents that did not have his signature.

The court held that this argument was invalid as the employee had failed to determine the exact faults of the ruling and the nature of the documents he claimed the court had established its ruling upon.

The court therefore dismissed the appeal.
