Background
An employee filed a case against a company requesting that the court order the company to pay his salaries.
The court ruled that the company pay the employee 7285.878 Dinars.
The company appealed and the appeal court upheld the ruling.
The company appealed by cassation.
Decision
Before the cassation court the company argued that the ruling had erred in the application of law as the court ruled that the company pay the employee his dues, however, the company had already paid the employee his dues in Iraqi Dinars and the employee had accepted such payment.
The court held that this argument was valid as there is not a relevant law preventing the employer from paying dues in a foreign currency. The court stated that the company had provided the court with documents confirming that the employee had received his dues.
The court therefore repealed the ruling.
