Background
An employee filed a case against a company requesting that the court order the company to pay his salaries.
The court ruled that the company pay the employee 6135 Dinars.
The company appealed and the appeal court upheld the ruling.
The company appealed by cassation.
Decision
Before the cassation court the company argued that the ruling had erred in the application of law as the court had ruled that the company pay the employee the value of overtime hours despite the fact the employee did not receive written assignment to work such hours.
The court held that this argument was invalid as the court had established its ruling on an expert report and the testimony of the company's manager who stated that he had assigned the employee two additional working hours per day.
The court therefore dismissed the appeal.
