KCC 19/1995

This case involved a claim by an employee for unpaid dues. A ruling was issued during the case which did not settle the case. Such a ruling could not be appealed.

Background

An employee made a complaint against a company and requested the Labour Department to order the company to pay his dues. The department referred the case to the court.

The court did not consider the case.

The employee appealed the ruling before the court of appeal. The court abandoned the appealed ruling and referred the case to the elementary court for consideration.

Decision

The company appealed the ruling before the court of cassation.

The Public Prosecution argued that the appeal should be dismissed and stated Article 182 of the Civil and Commercial Pleadings Law stipulated that a ruling which is issued during the consideration of the case and which does not settled the dispute cannot be appealed.

The court stated this argument was valid.

The court dismissed the appeal.
