KCC 68/1995

An employee filed a case against the owner of a company requesting that the court order the owner to pay her salaries.

The court ruled that the owner pay the employee 10405.100 Dinars.

The employee and owner appealed and the appeal court ruled that the owner pay the employee 13216.606 Dinars.

The owner appealed by cassation.

Decision

Before the cassation court the owner argued that the ruling had erred in the application of law as the court failed to discount the value of a loan the employee had received from amounts owed to the employee, in addition to 1700 Dinars the employee had received in a previous ruling.
