A case involved a dispute between an employee and a company over the payment of his dues.

Background

An employee filed a case against a company requesting that the court order the company to pay his dues.

The court ruled that the company pay the employee 191.706 Dinars plus the value of a flight ticket.

The employee appealed and the appeal court ruled that the company pay the employee 1641.706 Dinars plus the value of flight ticket.

The company appealed by cassation.

Decision

Before the cassation court, the company argued that the ruling had erred in the application of law as it had used its right under the employment contract to dismiss the employee during his probation period.

The court stated that this argument was invalid as the case documents revealed that the contract fell under the regulations of the Ministry of Education regarding private education which meant that any party could not terminate the contract during the teaching year without the approval of the ministry.

The court therefore dismissed the appeal.
