Background
An employee filed a case against a company requesting that the court order the company to pay his salaries.
The court ruled that the company pay the employee 4321.890 Dinars.
The company appealed and the appeal court ruled that the company had no right to appeal due to the lack of financial quorum.
The company appealed by cassation.
Decision
Before the cassation court the company argued that the ruling had violated the law as the court failed to consider the appeal as the value of the case did not exceed 5000 Dinars, however, this does not include labour cases.
The court held that this argument was invalid as Article 41 of the Kuwait Pleadings Law (as amended) stipulates that the final quorum of the plenary court is 5000 Dinars including labour cases.
The court therefore dismissed the appeal.
