Background
An employee filed a case against a company requesting that the court order the company to pay his salaries.
The court rejected the case.
The employee appealed and the appeal court upheld the ruling.
The employee appealed by cassation.
Decision
Before the cassation court the employee argued that the ruling had insufficient evidence of causation and contradicted material documentary evidence as the court had established its ruling based on the employee having signed a document by which he endorsed that he had received all his dues, however, he had only signed the section of the document which related to his salaries.
The court held that this argument was valid as the final settlement provided by the company revealed that the employee signed only the section which confirmed he had received 500 Dinars only, which meant that he had not received all his dues.
The court therefore repealed the ruling.
