Background
An employee filed a case against a company requesting that the court order the company to pay his salaries.
The court rejected the case.
The employee appealed and the appeal court ruled that the employee had no right to appeal the ruling.
The employee appealed by cassation.
Decision
Before the cassation court the employee argued that the ruling had erred in the application of law as the court had applied the statute of limitations under Article 96 of the Kuwait Labour Law, Kuwait Law No. 38/1964 regards residence insurance, however, this amount should have been considered as a separate right to labour rights.
The court held that this argument was invalid as the appeal had been filed against the first instance ruling and not the appealed ruling.
The court therefore dismissed the appeal.
