KAT 309/2001

This case involved whether a document received by a lawyer from the defendant's mother as a trustee for him could be considered a power of attorney.

Background

A legal representative of the appellant appealed a ruling before the court of cassation.

Decision

The court of cassation considered the issues which related to the public order. The court said that the documents of the case revealed that the lawyer had presented an authorization issued by the appellant's mother as a trustee for him. The court said that such authorization did not permit the lawyer to defend the case on the appellant's behalf. The court said that the bequest could not be considered as a power of attorney document.

The court dismissed the appeal.
