KAT 167/2001

This case involved the alimony payable to a divorced wife.

Background

A wife filed a case against her husband before the court. She requested the court to divorce her from husband. She said that he used to beat and insult her in a way that made living with him impossible.

The court ruled that the wife should be divorced from her husband.

The wife appealed the ruling before the court of appeal. The court amended the appealed ruling and ruled that the husband should pay living expenses of the wife.

The wife appealed the ruling before the court of cassation. She said in her grounds of appeal that the appealed ruling had erred in the application of law and had insufficient evidence of causation. She said that she had maintained before the court of appeal that the husband should pay her alimony but the court failed to consider this request.
