This case involved the method for selecting or objecting to the appointment of an arbitrator. It also covered the remit of the parties in deciding on rules and procedures.

Background

Article 16 of Jordan Law No. 31/2001 specified the methods for selecting arbitrators in the event the parties did not agree on their selection.

If the representative of the party did not raise the objection in accordance with Article 21(b) of Jordan Law No. 31/2001 the right to raise it was forfeited.

Decision

The decision of the arbitration panel was valid if it included the names and addresses of the parties and arbitrators, a summary of the arbitration agreement, a brief of the parties’ requests, statements, and documents, the pronouncement of the award and its reasons, the arbitrators’ fees, and arbitration costs and their distribution among the parties, and if the arbitration award was reasoned, in accordance with Article 41 of Jordan Law No. 31/200
