JCC 320/2015

The dispute involved the revoking of a right to appeal. A key issue was whether the Court had been mistaken and inconsistent with Article 239 of the Jordan Civil Code in its ruling and on the interpretation of a labour contract.

The case was brought against an Iraqi oil and gas company. The lawsuit was filed to allow workers to claim back 6,150 Dinars. A contract had granted an employee the position of Director within the company since 2010, on a fixed-term employment contract and a monthly salary.

The case was presented to challenge the verdict of Case No. 17553/2014, revoking the right to appeal, as issued by the Amman Magistrate's Court.

It was claimed the Court of Appeal had been mistaken and inconsistent with Article 239 of the Jordan Civil Code in its ruling and on the interpretation of the labour contract. It was allegedly mistaken in the legal basis for the ruling, and in applying conditions for arbitration which differed from the will and intent of the parties to the contract.

This case was reported in the Journal of World Arbitration, Volume 28, page 15.
