ICSID ARB/02/13

The original dispute concerned a claim for compensation arising from a disagreement between the Government of Jordan and the compant on the amount owed to the claimant for works done under a contract for a dam construction in Jordan. The key issues were whether the Tribunal had jurisdiction under the ICSID Convention and whether the contractual breaches constituted a breach of the Italy-Jordan Bilateral Trade Treaty (‘BIT’).

Facts

The claimants claimed that the Hashemite Kingdom of Jordan or Jordan had breached its obligations under the Italy-Jordan BIT and an investment contract. They sought compensation of approximately US$ 28,000,000.00, or a more precise amount which would be determined during the proceedings, plus interest and financing damages in an amount to be quantified by the Tribunal. They also sought an award ordering the respondent to bear all costs of the present arbitration and to reimburse the claimants of all legal and arbitration expenses incurred and to be incurred for the conduct of the proceedings.
