This case involved the revocation and compensation for failure to make supplies of goods under two contracts.

Background

A construction company filed a case before the First Instance Commercial Court against a British company claiming that the two had signed two contracts - the first had a value of 53,000 USD and an execution period of 200 days starting from the date of issue of the letter of credit. The second had a value of 206,472.85 USD with execution period of 120 days starting from the date on which the letter of credit was issued but the British company had failed to prepare the materials subjects of the two contracts despite legal warnings.

The construction company requested the revocation of both contracts and compensation of 300,000 USD plus payment of all costs and fees.
