Supply of Services – Hospital – Evidence – Admission – Legal Capacity – Manager
This case involved unpaid amounts for the supply of services to a hospital. Admission of liability was treated as evidence and the manager of the hospital did not have legal capacity to be a party to the case.
Background
A general trading company filed a case with the First Instance Commercial Court against the manager of a Hospital, and the Health Minister claiming that Hospital Manager should pay 313,000,000 Dinars for executing a contract under which the company had prepared food for patients but the hospital had failed to make the due payments despite several warnings. The hospital claimed that it did not have the necessary funds. The company requested payment of the outstanding payments, legal interest, and the payment of costs and lawyers' fees.
