This case involved a case filed by an electricity company before the First Instance Commercial Court against a Lebanese company claiming that they had signed a contract under which the Lebanese company should have provided the necessary materials for a factory at a price of 3,380,000 USD on the condition that the project was fully completed.

Background

The Lebanese company failed to execute most of the provisions of the contract and the company had to chase execution which lead to financial and administrative losses and other damages. The company requested the revocation of the contract and compensation for damages.

The court examined the case and a report submitted by the expert on the estimation of the entitlements of the company under Article 177 of the Civil Law.

The court issued a ruling revoking the contract and requesting the Lebanese company pay 2,249,693.80 USD in compensation for the revoking of the contract plus proportionate legal and lawyers' fees pursuant to the provisions of Articles 161, 166, 185, and 203 of the Advocacy Law, Articles 21, 22, and 140 of the Evidence Law, and Article 63 of the Lawyers Law.
