This case involved contracts to undertake construction work for a public sector department. The interior ministry tried to argue it was not liable to make the payments because the work had been done for army personnel. This was irrelevant as the contract was with the management of the border control force so the interior ministry was responsible for the contract obligations.
Background
A commissioner of a company filed a case with the Court of First Instance against the Interior Minister requesting they pay 333,339,645 Dinars. They had signed a contract with the border control authorities to do work on their headquarters and that of the coastal guard. The ministry had failed to make the payment following completion of the two projects.
