This case involved a claim by a Bulgarian Company that a design by the Iraqi authorities to remove their trademark registration and register the mark with another company was correct. Although, the company had used the trademark in Iraq for many years before the request it be cancelled, and had registered the trademark in a number of overseas jurisdictions including Greece and the UK both companies had been using the trademark in Iraq during the same period. Preference was given to the other company as it help innovation rights in Bulgaria which was the country of origin of the product.
