Social Insurance – Statute of Limitations – Amount Owed – Interest – Evidence - Expert
This case involved money owed by a company to a social insurance fund. It was wrong argued the expert report had wrongly calculated the amount due. However, the Council's warning to the company had not had the ruled impact on the statute of limitations. Guidance was also given on how delay interest should be calculated.
Background
The Supreme Council of Curative Care Insurance filed a case before the Court of First Instance against a hotel company requesting 11354,700 Egyptian Pounds with penalty interest for delay of payment. After examining the expert's report, the court rejected the request as it had been presented outside the statute of limitations; but the council appealed the Court of First Instance judgment which was then repealed by the Appeal Court and forced the company to pay the council 10935 Egyptian Pounds with penalty interest of 4% per year from 1984 until payment was made.
