Landlord – Tenant – Tenancy Agreement – Transfer of Ownership – Tenant died - Eviction
This case involved a request to evict tenants and terminate a tenancy agreement. The original tenant had died and the ownership of the property had transferred. The key point was the length of time the new owner had accepted rent from these tenants.
Background
A landlord filed a case against a tenant and requested the court to dismiss the tenancy agreement of a disputed flat and order the tenants to vacate it. The landlord stated the tenants' father had rented the flat from the previous owners who told the tenants that the ownership had transferred to another person. The landlord stated the tenancy agreement should be terminated because the original tenant, who is a Sudanese citizen, had died.
The court rejected the case.
The landlord appealed the ruling before the court of appeal. The court abandoned the appealed ruling and ruled the tenancy agreement should be dismissed and that the tenants should vacate the flat.
