Divorce – Second Marriage – Domestic Abuse – Evidence – Witnesses – Drugs
This case involved a request by a wife for a divorce because her husband had abused her and was taking drugs. The husband tried to argue there was insufficient evidence as the witnesses were related to his wife and he had already divorced his second wife. If a man married another woman and his caused damage to his original wife she had the right to divorce him.
Background
A wife filed a case against her husband before the plenary court requesting a divorce from her husband. The wife said that the husband used to insult her and to eject her from the house and that he was addicted to drugs.
The court ruled that the wife should be divorced from her husband.
The husband appealed the ruling before the court of appeal. The court upheld the appealed ruling.
