ECC 4169/70

This case involved a claim by a lawyer for costs of a case he had defended. There was an agreement between the parties for the lawyer to be paid a monthly amount this should be the basis for what the lawyer was owed.

Background

A lawyer filed a case against a defendant and requested the court order him to pay 45830 Egyptian Pounds for the costs of cases he had defended.

The court ruled that the defendant should pay the lawyer 13730 Egyptian Pounds.

The defendant and the lawyer appealed the ruling before the court of appeal. The court rejected the defendant's appeal and ruled the defendant should pay the lawyer 14900 Egyptian Pounds.

Decision

The defendant appealed the ruling before the court of cassation and stated in his grounds of appeal that the ruling had erred in the application of law because he had maintained before the court he had reached an agreement with the lawyer to pay him 300 Egyptian Pounds per month and this agreement lasted for two years. The defendant provided the court with a document which confirmed the agreement.
