Background
The Real Estate Publicity Department issued an estimation order of 954.550 Egyptian Poinds as fees to the defendant. The defendant introduced a plea and requested the court to dismiss the order.
The court ruled that the order should be dismissed.
The two claimants appealed the ruling before the court of appeal. The court upheld the appealed ruling.
Decision
The two claimants appealed the ruling before the court of cassation and stated in their grounds of appeal that the ruling had erred in the application of law and that the court had applied Egypt Law No. 6/1990 over the case though Article 21 of Egypt Law No. 70/1964 should have been applied over the case.
The court said that this argument was invalid because the constitutional court ruled that clause B of the Article 21 of Egypt Law No. 70/1964 was unconstitutional.
The court dismissed the appeal.
