ECC 399/66

This case involved a request to dismiss and obedience order and grant a divorce. The husband's appeal was dismissed as he did not fully explain why the ruling had violated Article 6 of Egypt Law No. 25/1929.

Background

A woman filed a case against her husband and requested the court to dismiss an obedience warning issued by the husband and divorce them. The woman stated the husband used to insult her and refused to pay her living expenses.

The court rejected the case.

The woman appealed the ruling before the court of appeal. The court abandoned the appealed ruling and ruled the woman should be divorced from her husband and the obedience warning should be dismissed.

Decision

The husband appealed the ruling before the court of cassation and stated in his grounds of appeal that the ruling had violated the right of defence because the court had ignored his defence in violation to Article 6 of Egypt Law No. 25/1929.

The court stated this argument was invalid because the husband had not explained why the ruling violated Article 6 of Egypt Law No. 25/1929.

The court dismissed the appeal.
