Employee’s Rights – Service – Leave of Absence – Termination of Employment – Dismissal
This case involved the dismissal of an employee who had been on a leave of absence. The employer's had the right to follow their policy on this issue and she had failed to return at the agreed time.
Background
An employee filed a case against a bank before the court requesting the cancellation of a dismissal decision and addition of an absence period to her service. The employee said that she was travelling abroad with her husband and the bank dismissed her from her job.
The court ruled that the dismissal decision should be cancelled and that the period of absence should be added to the employee's service. The court ruled that the bank should pay the employee her entitlements.
The bank appealed the ruling before the court of appeal. The court upheld the appealed ruling.
