Employee’s Rights – Salary – Promotion – Appraisal Grade
This case involved a request by an employee for a promotion and entitlements. The court had been wrong to rule they should be promoted as contrary to the employer's policies they had not received the required appraisal grade.
Background
An employee filed a case against a bank before the court requesting the validation of his seniority and promotion and payment of his entitlements.
The court ruled that the employee's seniority should be validated and the bank should promote him and pay his entitlements.
The bank appealed the ruling before the court of appeal. The court upheld the appealed ruling.
Decision
The bank appealed the ruling before the court of cassation and said in its grounds of appeal that the ruling had insufficient evidence of causation and that it had maintained before the court that the employee did not deserve the promotion because he had failed to receive an “Excellent” grade in his work appraisal.
