ECC 380/71

This case involved an employee who requested he be awarded a promotion. Having an academic degree did not automatically force an employer to promote an individual.

Background

An employee filed a case against a company and requested the court to order the company to appoint him as an electricity specialist on the fourth grade.

The court ruled that the company should appoint the employee to that grade.

The company appealed the ruling before the court of appeal. The court upheld the appealed ruling.

Decision

The company appealed the ruling before the court of cassation and stated in its grounds of appeal that the ruling had erred in the application of law. It stated the promotion of an employee based on having an academic degree was not obligatory and that the company had authority over this issue in relation to their business interest.

The court stated this argument was valid.

The court repealed the ruling and abandoned the appealed ruling and rejected the case.
