Background
A landlord filed a case against a tenant and requested the court to order the tenant to vacate a disputed property. The landlord stated the previous owner had rented two rooms to the tenant's father to use as a lawyer office. The landlord stated the tenant's father had died after Egypt Law No. 6/1997 came into force.
The court ruled that the tenant should vacate the disputed property.
The tenant appealed the ruling before the court of appeal. The court upheld the appealed ruling.
Decision
The tenant appealed the ruling before the court of cassation and stated in his grounds of appeal that the ruling had erred in the application of law because he had maintained before the court that he had assigned another lawyer to practice in the same way in his father's office but the court had ignored this defence and violated Article 1 of Egypt Law No. 6/1997.
