This case involved a request to evict tenants who it was claimed sublet a property and used it as a house. The appeal court should have considered all areas considered by the court of first instance. Although there was no evidence of a sublet there was evidence the property had been used for residential purposes when this was not allowed in the tenancy agreement.
Background
Some landlords filed a case against two tenants before the court requesting the tenants to vacate a rented property. The landlords said that the tenants used the property as a house in violation to the tenancy agreement and they had rented it out to a third party without their approval.
The court ruled that the tenants should vacate the rented property.
The tenants appealed the ruling before the court of appeal. The court dismissed the appealed ruling.
