Background
Some Greek nationals filed a case before South Cairo Court of First Instance against property owners requesting cancellation of sales contracts for properties they had acquired from the legal guardian of the plaintiffs ‘inheritance and was appointed illegally by a Republic Decree.
The Court of First Instance ruled in favour of the plaintiffs, but the defendants filed an appeal and the Appeal Court confirmed the ruling.
Decision
The plaintiffs filed an appeal in cassation on the ground that the appealed ruling had erred in the application of the law because the application of the provisions of the Greek Arab Convention was irrelevant in this conflict as the appointment of a legal guardian had been done without any official judgment.
