Landlord – Tenant – Deceased Former Tenant – Refusal to Pay Rent – Inheritance – Court – Jurisdiction – Case Value - Eviction
This case involved a dispute over the eviction of heirs of a former deceased tenant who had refused to pay rent for the property. The key question was which court should hear the case. The amount was small but the case involved the rental relationship.
Background
A landlord filed a case against some tenants and requested the court to dismiss a tenancy agreement dated 05/05/1967 and order them to vacate a shop. The landlord stated the tenants' father had rented the shop from him but the tenants had refused to pay the rent after the father died.
The tenants filed a case against the landlord and requested the court to validate that the shop was empty when it was rented.
The court rejected the tenant's case and ruled the tenancy agreement should be dismissed and that the tenant should vacate the shop.
The tenants appealed the ruling before the court of appeal. The court upheld the appealed ruling.
