ECC 235/2001

This case involved whether a rent should be decreased or a tenant evicted. The court should have followed the rent ruled on by the rent commission.

Background

A tenant filed a case against a landlord before the court requesting the landlord decrease the rent in accordance with the estimation of the rent commission.

The landlord filed a case against the tenant before the court requesting the dismissal of the tenancy agreement and eviction of the tenant. The landlord said that the tenant had failed to pay the rent in time.

The tenant appealed the ruling before the court of appeal. The court upheld the appealed ruling.

Decision
