Background

A woman filed a case against her husband and requested the court dismiss an obedience warning issued by her husband and divorce them. The woman stated the husband used to insult and hit her and that the house provided by him was illegal.

The court rejected the case.

The woman appealed the ruling before the court of appeal. The court abandoned the appealed ruling and ruled the obedience warning should be dismissed and the woman should be divorced.

Decision

The husband appealed the ruling before the court of cassation and stated in his grounds of appeal that the ruling had erred in the application of law and had insufficient evidence of causation as the court had established its ruling based on the woman's witnesses although there had been contradictions.

The court stated this argument was invalid because witness statements included no contradictions and were related to the subject of the case.
